We strictly prohibit the sending of unsolicited messages, spam, deceptive marketing, or any content that violates carrier regulations and local telecommunications laws.
All users must obtain explicit, verifiable opt-in consent from recipients prior to sending SMS or MMS campaigns. SmartFlow reserves the right to audit subscriber lists, suspend message delivery, or terminate accounts immediately if suspicious sending patterns are detected or if carrier penalties are incurred.
TL;DR: Because we are based in Santa Ana, CA, any formal legal disputes related to our service will be handled there under California law.
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Santa Ana, California, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
